Please review these terms governing the access and utilization of the DSenergize platform, edge dataloggers, CMMS workflows, and telemetry software.
Acceptance of Terms
By accessing, browsing, or utilizing the web platform at dsenergize.com, its associated mobile applications, APIs, or telemetry dashboards, you agree to be legally bound by these Terms of Use and all applicable laws and regulations in India. If you disagree with any portion of these terms, you must immediately discontinue using our website and services.
Corporate Identity and Purpose
The platform DSenergize is designed, owned, and operated by Fowlat Technologies Pvt. Ltd., a private limited company incorporated under the Indian Companies Act, 2013. Primary business activities include:
- Construction, engineering, and maintenance of power, telecommunication, and transmission lines.
- Sourcing, developing, and deploying IoT monitoring hardware, dataloggers, and cloud infrastructure.
- Research-driven technology integration for solar energy yield analytics, CMMS work orders, and SLD electrical mapping.
These services strictly operate under the scope authorized in Clause 3 of Fowlat Technologies' Memorandum of Association (MOA).
Use License & Platform Restrictions
Users are granted a limited, revocable, non-exclusive, and non-transferable license to access monitoring telemetry and digital assets for internal operational purposes. Under this license, you agree NOT to:
- Modify, copy, or redistribute platform source code
- Use content for unauthorized commercial syndication
- Reverse-engineer SCADA drivers or dashboard algorithms
- Remove trademark notices or proprietary copyright badges
- Mirror or frame dsenergize.com on external domains
- Attempt unauthorized penetration testing or data scraping
Breach of these covenants results in automatic termination of access and potential civil or criminal proceedings.
Account Security & Credentials
Authorized operators must maintain the strict confidentiality of their Multi-Factor Authentication (MFA) credentials, API keys, and login passwords. Sharing enterprise user accounts across unauthorized personnel is prohibited.
Feature Availability & Service Evolution
DSenergize continuously enhances its software suite. We reserve the right to deploy, modify, refactor, or deprecate features—including 1-minute telemetry streams, Excel automated exports, instant WhatsApp bot notifications, or drone photogrammetry viewers—to maintain platform security, scalability, and industry compliance.
Intellectual Property Rights
All software code, database architectures, user interface designs, dynamic Single Line Diagrams (SLD), trade dress, logos, and technical documentation are the exclusive intellectual property of Fowlat Technologies Pvt. Ltd. No portion of the platform may be extracted, duplicated, or distributed without prior written consent from the board of directors.
Service Disclaimer & Warranties
The services and telemetry data provided on dsenergize.com are supplied on an "as-is" and "as-available" basis. While our edge loggers maintain 99.9% uptime SLA, we do not warrant:
- Uninterrupted telemetry transmission during upstream cellular network provider outages.
- Absolute immunity from uncalibrated third-party pyranometer sensor drift.
- Specific revenue outcomes dependent on fluctuating grid tariffs or regulatory policies.
Limitation of Liability
In no event shall Fowlat Technologies Pvt. Ltd., its directors, employees, or technical partners be held liable for indirect, punitive, incidental, or consequential damages—including loss of power revenue, data loss, or business interruption—arising from the use or inability to use the monitoring platform.
Third-Party Links & Integrations
Our platform may integrate with third-party cloud hosting providers, WhatsApp Business APIs, weather satellite feeds, or DISCOM net-metering gateways. Fowlat Technologies exercises no direct control over external protocols and assumes no liability for external service modifications or privacy practices.
Governing Law & Legal Jurisdiction
These Terms of Use are governed by and construed in accordance with the substantive laws of Delhi, India. Any dispute, arbitration, or legal proceeding arising from these terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi.
Corporate Disclosure & Regulatory Status
“DSenergize” is a proprietary brand developed and maintained by Fowlat Technologies Pvt. Ltd. (CIN: Registered in Delhi). All corporate rights, contracts, intellectual property stewardship, and compliance disclosures are managed under its corporate governance mandate.
